Prof. Dr. Adrian Schmidt-Recla

Zwangsmedikation von psychisch Kranken

Abstract from the author

Portrait des AutorsThis paper introduces the recent legislative reform of § 1906 BGB. Driven by the 2008 UN-Convention on the Rights of Persons with Disabilities and by the jurisdiction of the German Bundesverfassungsgericht the Bundestag has sparingly implemented a new rule on forced medication of the mentally ill into German Civil Law. This introduction shows first the scope of this special rule second the criteria of licit forced medication according to this rule and third the procedural framework to be observed once forced medication is considered by legal guardians and physicians.
