Plagiate, Datenfälschung und kein Ende – Rechtliche Sanktionen wissenschaftlichen Fehlverhaltens

Portrait des AutorsVor dem Hintergrund aktueller Fälle wissenschaftlichen Fehlverhaltens erläutert der Autor Arten und Ursachen von Verstößen gegen die gute wissenschaftliche Praxis, wobei er sich nicht nur auf die medial derzeit besonders interessanten Plagiate beschränkt. In diesem Zusammenhang werden die rechtlichen Konsequenzen in verschiedenen Rechtsgebieten beleuchtet. Hierbei erhält die juristische Einordnung von Plagiaten besonderes Gewicht. Neben urheber- und strafrechtlichen Aspekten werden vor allem die rechtlichen Voraussetzungen für die Entziehung akademischer Grade (insbesondere von Doktortiteln) thematisiert. Vielfach fehlen hierzu spezialgesetzliche Regelungen, sodass Universitäten und Gerichte auf Generalklauseln oder Normen in Promotionsordnungen zurückgreifen müssen. Aus verfassungsrechtlichen Gründen und zugunsten der Rechtssicherheit sind klarere Regelungen angezeigt, auch wenn die bisherigen Rechtsgrundlagen bereits zahlreiche wirksame Sanktionen ermöglichen.
